Texas Health and Human Services published a Long-Term Care Regulation Provider Letter on May 22, 2023, for the Home and Community Support Services. This provider letter outlines new reporting requirements for Abuse, Neglect and Exploitation effective July 1, 2023. Suspected ANE for Medicaid consumers are to be reported to Department of Family and Protective Services (DFPS) or Complaint and Incident Intake (CII) based on who commits the suspected ANE. Education on reporting is also required to be provided to consumers. Beginning September 1, 2023, all suspected ANE, regardless of payor, will be reported to the DFPS or CII based on the suspected abuser. For complete information see the provider letter HERE. All home health and hospice providers should be educated on their state’s ANE regulations, as failure to do so may result in financial penalties, agency violations and/or incarceration.
